These Terms of Service ("Terms") govern your access to and use of the prosperus.digital website, our free tools and content, and the services provided by Prosperus Digital. By using the site or engaging our services, you agree to these Terms.

By accessing or using our website, tools or services, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site or the services.

Prosperus Digital is a sole proprietorship providing revenue-infrastructure and marketing services, together with free tools, resources and content published at prosperus.digital. In these Terms, "Prosperus Digital", "we", "us" and "our" refer to that business.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use our services. If you use the services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
4. Our services & tools
The website provides information about our work and offers free tools and content for general informational purposes. These tools and content are provided "as is", may change or be withdrawn at any time, and do not constitute professional, legal, financial or investment advice.
5. Client engagements
Paid services are provided under a separate written proposal, statement of work or services agreement ("Engagement Terms") agreed between you and Prosperus Digital. Where anything in these Terms conflicts with the Engagement Terms for a specific project, the Engagement Terms prevail for that project. Unless stated otherwise in the Engagement Terms, deliverables are handed off to the client on full payment, together with relevant documentation, as described in our standard way of working.
6. Acceptable use
When using our site and tools, you agree not to:
- use them for any unlawful, harmful, or fraudulent purpose;
- attempt to gain unauthorised access to, disrupt, or overload the site or its infrastructure;
- scrape, copy or resell our content or tools except as expressly permitted;
- reverse engineer or misuse any tool, or infringe the rights of others.
7. Intellectual property
The website and its content — including text, design, graphics, logos and tools — are owned by Prosperus Digital or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the site for its intended purpose. You may not reproduce, distribute or create derivative works from our content without our prior written permission. Ownership of custom deliverables created during a paid engagement is governed by the applicable Engagement Terms.
8. Third-party platforms & links
Our services rely on and integrate with third-party platforms such as Meta, Google, Shopify and others, and our site may link to third-party websites. We do not control those platforms or sites and are not responsible for their availability, content, changes or practices. Your use of any third-party platform is subject to that platform's own terms and policies, which you are responsible for complying with.
9. Disclaimers
The website, tools and content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We guarantee delivery of what we scope in an engagement, but — like any honest partner — we do not guarantee specific revenue, ranking, traffic or business outcomes, which depend on many factors outside our control.
10. Limitation of liability
To the maximum extent permitted by law, Prosperus Digital will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or relating to your use of the site, tools or services. Our total aggregate liability arising out of or relating to the free site and tools will not exceed EUR 100; liability arising from a paid engagement is governed by, and limited as set out in, the applicable Engagement Terms.
11. Indemnification
You agree to indemnify and hold harmless Prosperus Digital from any claims, damages, liabilities and expenses arising out of your misuse of the site, tools or services, or your breach of these Terms or of any third-party rights or platform policies.
12. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
13. Governing law & disputes
These Terms are governed by and construed in accordance with the laws applicable at Prosperus Digital's principal place of business, without regard to conflict-of-law principles. You agree that the courts of that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where mandatory consumer-protection law gives you the right to bring proceedings in your own place of residence.
